The following terms, conditions, and release (“Official Rules”) govern participation in the 2024 Home(body) for the Holidays Giveaway (the “Giveaway”), sponsored by Homebody Insurance Agency, LLC (“Sponsor”). If you do not agree to be bound by all the following terms and conditions of the Official Rules, please do not submit an entry.
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE FROM SPONSOR WILL NOT INCREASE YOUR CHANCES OF WINNING.
- Sponsor and Address: Homebody Insurance Agency, LLC, located at 4205 Chapel Ridge Road, Lehi, UT 84043, is the sponsor of the Giveaway.
- Eligibility: The Giveaway is only open to participation by legal residents of the 50 United States and the District of Colombia and is void where prohibited by law. Legal residents must be 18 years of age or older (or the applicable age of majority) at the time of entry. Employees, officers, and directors of Sponsor and members of their immediate family are not eligible to participate.
- Giveaway Period: The Giveaway begins on December 3, 2024 at 12pm and ends on January 3, 2025 at 11:59am (MST).
- How to Enter: Entries may be received only by one of two methods during the Giveaway period. For new users, an Entry will be deemed submitted when a participant: 1) downloads the Homebody app on their mobile device and 2) creates a Homebody account. For existing users, an Entry will be deemed submitted when a participant logs in to their Homebody account after they have been inactive within the app for a specified period of time, as determined by Sponsor in its sole discretion. Limit one Entry per person.
- Prizes: Three (3) winners will receive a digital gift card in the amount of $100. The prize is non-transferable and no cash alternative will be offered.
- Winner Selection and Notification: Winner Selection and Notification: The winner will be selected in a random drawing from among all eligible entries received. The winner will be notified by email on or about January 3, 2025. If the winner cannot be contacted or does not claim the prize within 30 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.
- Publicity: Except where prohibited, participation in the Giveaway constitutes the Winners’ consent to Sponsor’s use of their name and likeness for promotional purposes in any media without further payment or consideration.
- General Conditions: Sponsor reserves the right to cancel, suspend, and/or modify the Giveaway, or any part of the it, if any fraud, technical failures, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Giveaway, as determined by Sponsor in its sole discretion. Furthermore, Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected entries, which will be disqualified. Lastly, by entering the Giveaway, participants agree to be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all respects relating to the Giveaway. Participants acknowledge that they have read and understand these Official Rules and agree to be bound by and comply with these Official Rules, including, without limitation, eligibility requirements. A participant’s failure to comply with the Official Rules will result in the participant being ineligible to win a Prize in the Giveaway. Each Winner is solely responsible for all applicable federal, state and local taxes, including taxes imposed on his/her income.
- Release and Limitation of Liability: By participating in the Giveaway, participants agree to release and hold harmless Sponsor, its affiliates, subsidiaries, and all agencies, directors, employees, and agents (“Giveaway Parties”) from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of any Prize. In addition, each participant further agrees that in any cause of action, the Giveaway Parties’ liability will be limited to the cost of participating in the Giveaway, and in no event shall the Giveaway Parties be liable for attorneys' fees, punitive, consequential, direct or indirect damages, and each participant waives the right to claim any damages whatsoever.
- Governing Law: This Giveaway is governed by the laws of the State of Utah, without regard to conflict of law principles.
